Verint Wins Patent Lawsuit Against Nice Systems on Speech Analytics Technology

Jury Validates Verint Speech Analytics Patent and Finds Nice to Infringe

MELVILLE, N.Y., May 19, 2008 – Verint Systems Inc. today announced the jury in the U.S. District Court for the Northern District of Georgia ruled unanimously in favor of Verint® in a patent infringement lawsuit brought by Verint against Nice Systems, awarding Verint more than $3.3 million USD in damages.

The jury found that the Verint patent pertaining to speech analytics is valid and enforceable and that Nice Perform® with speech analytics infringes on that patent. “We are pleased that the jury validated the innovations of our patent, and the creativity of our people. The verdict demonstrates Verint's resolve to defend our intellectual property vigorously, as well as the strength of Verint's patent portfolio,” says Dan Bodner, CEO and President of Verint Systems. “This winning verdict coincides with Verint’s significant 400th patent applications milestone.”

Adds Nancy Treaster, senior vice president and general manager of Verint Witness Actionable Solutions, “The jury’s finding of infringement and validity greatly enhances the value of Verint’s patent portfolio and validates Verint as the first-mover and the true innovator of speech analytics for contact centers.”

The Verint patent that was found to be infringed by Nice Systems covers systems and methods for, among others, analyzing speech to identify, for example, emotion, words, and talk-over. Verint next plans to seek a permanent injunction to enjoin Nice Systems in the United States from making, using, selling, offering for sale or importing any infringing speech analytics products, including speech analytics offered with Nice SmartCenter™, Nice Perform®, NiceUniverse® and NiceAdvantage®.

“Verint is the world’s leading provider of workforce optimization solutions. Behind our leadership is a long history of developing market-leading, innovative solutions for emerging markets, such as contact center analytics. Speech analytics, which enables enterprises to uncover valuable customer insights, find implicit customer needs and wants, and identifies the root causes of issues embedded in conversations, is a growth area and key differentiator in the market. The jury’s verdict reinforces our market leadership and distances us further from the competition,” concludes Treaster.
